With all the condominium and construction developments going on, adjacent property owners are often approached by Developers seeking permission to drill and install tiebacks or shotcrete nail anchors under their property .
This benefits the Developer because they can construct the foundation of their development cheaper and faster this way. Developers do not have a right to do this unless the adjacent property owner gives them permission.
Remember, you own the soil and bedrock under your property, as well as the air rights above your property.
A Developer will make first contact with you by mail or a knock on your front door.
As for when?
A Developer should be contacting you after they have received approval of their Development Permit (DP) or shortly after they submit their application for a Building Permit (BP), at the very latest.
The reality is that the Developer may contact you at the last minute to pressure you to quickly sign an agreement .
The worse thing you can do is to ignore the Developer as this will weaken your position. If/when the Developer contacts you, do not worry and do not agree to anything.

Without your permission as the property owner, the Developer is effectively trespassing onto your property.
Construction cranes are not permitted to carry a "live" load over neighbouring properties, especially when there are inhabitants on the property.

Lawyers will play a part in drawing up the legal agreement. They can only give you a "ball park" dollar figure, but then you run the risk of leaving a significant amount of compensation on the table. Wouldn't you want to have an expert with the most updated information in order to negotiate top dollar?
It may take a few weeks, to a few months, or maybe even a year. It depends on the complexity of the project and how thorough and well-protected you want to be.
Developers can complete the deal privately with you within a week, but your interests will not be protected. ACCESS does NOT recommend this approach.
